Kimmirut teacher faces sex charges: RCMP

Another Nunavut teacher faces sex charges, the RCMP reported April 9.

Members of the RCMP detachment in Kimmirut conducted an investigation after receiving a complaint about a historical sexual assault.

On April 8, a Kimmirut school teacher was charged with one count of sexual assault and one count of sexual exploitation, the RCMP said in a news release.

According to the Criminal Code of Canada, sexual exploitation occurs when someone “who is in a position of trust or authority” touches, invites, counsels or incites a young person to touch, “directly or indirectly, with a part of the body or with an object, the body of any person, including the body of the person who so invites, counsels or incites and the body of the young person.”

Police said the teacher has been released with conditions to abide by until the next court appearance, including no contact with persons under 18 unless another “appropriate adult” is present inside the same room.

Conviction on a sexual exploitation charge can result in a prison term from one to 10 years.

Police said the names of everyone involved in the investigation would not be disclosed “to protect the identities of those [allegedly] victimized.”

That teacher has since been identified as Philip Flynn, a teacher at Qaqqalik school, who will appear in court Kimmirut next August.

A teacher, now identified as Mark Caine, from Aqsarniit Middle School in Iqaluit, who faces three charges of sexual interference, is to appear in the Nunavut Court of Justice April 12.
